Site Usage Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website www.logotech-ise.com (the "Site"), operated by I.S.E. S.r.l., with registered office at Via delle Driadi, 45, 00133 Rome, Italy ("ISE", "we", "us", "our"). By accessing or using the Site, including by registering for an account, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Information Addressed to Healthcare Professionals

The Site presents in vitro diagnostic (IVD) medical devices intended for professional use only. Content on the Site is addressed to healthcare professionals, laboratory personnel, and procurement contacts, and does not constitute medical advice. Our products comply with the requirements of Regulation (EU) 2017/746 (IVDR) and, where applicable, the transitional provisions relating to Directive 98/79/EC. Instructions for Use (IFU) must always be consulted before using any ISE product; nothing on the Site replaces the IFU or the judgment of a qualified professional.

2. Accuracy and Currency of Information

We make reasonable efforts to keep the Site’s content accurate and up to date, but we do not warrant that all information - including product specifications, availability, or regulatory status - is complete, current, or error-free. Product availability and specifications may vary by country. Product images on the Site are for illustration only; actual product information and packaging may vary. Specifications are subject to change without prior notice. Historical or archived information is provided for reference only. You should verify critical information (e.g., product certification status, IFU version) with ISE directly before relying on it.

3. Intellectual Property

All content on the Site - including text, graphics, logos, product images, layout, software, and their selection and arrangement - is the property of ISE or its licensors and is protected by Italian and EU copyright, trademark, and related laws. All rights reserved. You may view, download, and print material from the Site for personal, non-commercial, or internal business reference use only, provided you do not remove any copyright, trademark, or proprietary notice. Any other use - including reproduction, modification, distribution, public communication, or creation of derivative works - requires ISE’s prior written consent.

“ISE,” associated logos, and product names (e.g., Miura, Hemo One) are trademarks of ISE or its licensors. All other trademarks mentioned on the Site are the property of their respective owners. Nothing on the Site grants any licence to use these marks without our prior written permission.

4. Website Registration and Account Terms

Certain areas of the Site (the members' area, customer portal, or newsletter sign-up) require registration.

4.1 Eligibility. Registration is intended for professional users - healthcare institutions, laboratories, distributors, and their authorised staff - and for individuals of at least 18 years of age acting on behalf of such organisations.

4.2 Accurate information. By registering, you agree to provide true, accurate, current, and complete information, and to keep it up to date.

4.3 Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [contact us] if you suspect unauthorised use of your account.

4.4 Free and non-compulsory. Registration on the Site is free and not compulsory; declining to register does not affect your ability to browse the Site's public content, though it may limit access to certain services (e.g., technical documentation, order tracking).

4.5 Termination. ISE may suspend or terminate an account, or refuse registration, at its reasonable discretion - including in cases of inaccurate information, misuse of the Site, or a security concern - without prejudice to any other right or remedy.

4.6 Data processing. Registration data is processed in accordance with our Privacy Notice, which forms part of your agreement with us regarding use of the Site.

5. Acceptable Use

When using the Site, you agree not to:

  • use any hardware, software, or automated means to interfere with, damage, or disrupt the Site's operation or security;

  • attempt to gain unauthorised access to any account, system, or data;

  • upload or transmit unlawful, defamatory, infringing, or malicious content (including malware);

  • use contact details published on the Site for unsolicited commercial communications;

  • frame, mirror, or scrape Site content without our prior written consent;

  • use the Site in a manner that infringes the rights of ISE or third parties.

We reserve the right to restrict or terminate access to the Site, or any part of it, at our discretion, for any breach of these Terms.

If you submit content to the Site (e.g., through a contact or registration form), you warrant that it is accurate and that you have the right to submit it. You grant ISE a non-exclusive, royalty-free licence to use such content for the purpose for which it was submitted (e.g., responding to your enquiry, processing your order). The Site may contain links to third-party websites for your convenience. ISE does not review or control these sites and is not responsible for their content, policies, or practices. Inclusion of a link does not imply endorsement.

To the fullest extent permitted by applicable Italian and EU law, ISE disclaims warranties of any kind regarding the Site's availability, accuracy, security, or fitness for a particular purpose, other than warranties that cannot be excluded by mandatory law. Nothing in these Terms limits ISE's statutory obligations regarding product conformity and safety under the IVDR or applicable consumer protection law.

9. Limitation of Liability

To the extent permitted by applicable law, ISE shall not be liable for indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site, except in cases of wilful misconduct or gross negligence, or where liability cannot be limited under mandatory provisions of Italian law (including product liability rules applicable to medical devices). Nothing in these Terms excludes or limits liability for death or personal injury caused by a defective product, to the extent such liability arises under mandatory law.

10. Indemnification

You agree to indemnify and hold ISE harmless from claims, damages, and reasonable costs arising from your breach of these Terms or misuse of the Site, to the extent permitted by applicable law.

11. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any dispute arising from or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the Court of Rome, Italy, without prejudice to any mandatory consumer-protection venue rules that may apply if you are acting as a consumer.

12. Changes to These Terms

We may update these Terms from time to time by posting a revised version on the Site, with an updated "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. Material changes will be highlighted on the Site's homepage.

13. Severability

If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will continue in full force and effect.
